Orders are not binding on www.probapro.com until accepted and probapro.com reserves the right to limit the quantity of any merchandise ordered and/or refuse service to any customer without prior notice. Verification information may be required prior to acceptance of any order.

Our goal is to have a 100% error-free website. If a product pricing error is discovered, we will immediately correct it on our system and apply the corrected price. We will notify you if your order contains items that have been priced incorrectly.

Payment can be made by paypal, Visa, MasterCard, American Express, credit card, direct deposit and wire transfer. Your credit card will be charged at the time the order is placed.

You are responsible for paying any state and local sales, use or value added taxes that may be applicable to your order. Sales tax is based on the full price of the invoice and may include shipping and handling charges if required by law.Probapro must charge VAT on all European orders.

Orders with "in stock" status will be shipped within 1-2 business days. "Backorder" status orders will be shipped based on manufacturing time.

We accept international shipments. We ship to countries that can be reached by courier. Customer will be required to pay local duties and taxes.

We stand behind our products and if you are not satisfied with your purchase, you will notify us within 30 days of receiving the product and we will refund or replace it. We charge a 0 restocking fee. Refunds will be made in the original form of payment. All returns must arrive in the original packaging and all shipping charges for returns will be paid by the customer. Orders over $1,000 are not included in the return policy. If we make a mistake in shipping your order or if it is damaged during shipment, Probapro will, at its sole discretion, replace or refund any damaged or incorrect items and any applicable shipping charges. Please note any obvious damage, shortage or incorrectly shipped items while applying your signature at the time of delivery and file all replacement or credit claims within 14 days of delivery.

To the maximum extent permitted by law, probapro.com shall not be liable for any special, indirect, exemplary or incidental damages (including loss or anticipated revenue or profits in connection therewith) arising out of any claim relating to these terms of sale, this site, catalog, products or orders, whether such claim is based on warranty, contract, tort (including negligence or strict liability) or other cause. in no event shall probapro's collective liability exceed the amount paid by you to company for the applicable order or product for which liability arises. these limits shall apply even if the essential purpose of any remedy is not met.

Resellers may not sell our products on other e-commerce sites without our consent, and sales are only permitted with authorization.

These Terms of Sale shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts applicable to contracts made and to be enforced wholly within the Commonwealth of Massachusetts.

If any provision of these Terms of Sale is found by a court or tribunal of competent jurisdiction to be illegal, unenforceable or in conflict with any law, such provision shall be deemed severable from these Terms of Sale and the validity of the remainder of these Terms of Sale will not be affected thereby.
